I Received a Notice of Violation – Now what? 

A Notice of Violation is issued to residents of Northside Meadow when a home owner’s property is out of compliance with the restrictions as described in the CCR’s or other rules.  This notice was issued by the association when an inspector notices a violation during property inspections.  According to Texas Law, a written notice must be issued informing the home owner of the violation and the remedy of the violation. 

What do I do now?  You have several options.  First, you can remedy the violation that was described in the notice.  For example, if it states that the yard has weeds, simply remove the weeds.  By default, a twelve-day period is given to remedy the situation.  If more time is needed for the cure, contact Goodwin Management or the board in writing for more time to resolve the violation. 

If there are questions regarding the violation, or clarification is needed, contact Goodwin Management or the board and request the information needed within the twelve-day window period to avoid a violation with a fine. Goodwin Management or the board will respond to your questions in a timely manner.   

The notice is issued to give the homeowner an opportunity to address any deficiencies within a timely manner. Opening a dialog between Goodwin Management, the board and the home owner does not stop the clock; however, additional time may be given to resolve the violation.  When the initial twelve-day period in the notice expires, a second Notice of Violation with a fine may be issued. 

When a homeowner wishes to challenge a notice, he or she must request a hearing within 30 days to present his or her side of the story to the board.  The board will consider all the information and make a final determination, at which point the homeowner will be advised.  If the board decides in favor of the homeowner, then the matter is closed.  Otherwise, the homeowner will be required to cure the violation and/or pay any fine(s) due immediately.
